CINCINNATI (WKRC) - A U. S. judge on Thursday rejected a request by the drugmaker Teva Pharmaceuticals Inc. to block its U. marketing of the arthritis drug, Celebrex.

Judge Amy Kors has ruled that the manufacturer is entitled to marketing of Celebrex in the U. and that the FDA has not approved it.

The company's drug is the first of its kind to be approved by the FDA and was launched in the United States in May. Celebrex is the second most-used prescription drug in the U. and is the only one approved to treat the condition.

The judge also rejected the manufacturer's request to have the drug promoted for use in children.

In May, the U. Department of Health and Human Services approved a pediatric indication for the treatment of juvenile rheumatoid arthritis and juvenile lupus.

The FDA approved Celebrex for use in juvenile rheumatoid arthritis in July, and in October, the U. Food and Drug Administration approved it for use in juvenile lupus in December. Both indications are now under pediatric approval.

The FDA has not approved Celebrex for use in children, however, and is expected to continue to market it in pediatric patients until the agency approves it for use in children in May.

In December, the FDA approved the use of the drug in adolescents. The drug is also being studied for the treatment of juvenile rheumatoid arthritis and arthritis of the knee in adults.
